Synopsis

This study is organised into three main sections. Following a brief review of the various revisions of the treaties on which the EU is founded, the first section examines the issue of the legal nature of the Treaty establishing a Constitution for Europe. From this perspective, the second section analyses those aspects of the treaty that could potentially lead to its formal adoption as a constitution, currently a distant prospect due to the considerable international dimension of the entire integration process. The third and final section examines the extent to which the proposals included in the treaty support a certain intergovernmental process that presently seems to be implicit in the process. The overall aim is thus to examine how the underlying interstate relations in the European Union can be reorganised, either to strengthen this intergovernmental dimension and/or to further progress along the path to integration.
